Councillors Launch Judicial Review Against Minister's Refusal To Rename Herzog Park
Represented by Shortall Law, they argue that proposals to change the placenames of two Dublin City parks, Herzog Park and Diamond Park – the former named for Irish-born Israeli president Chaim Herzog – have stalled due to the Minister's inaction.
Six of the fourteen Dublin City councillors on the Commemorations and Naming Committee have launched judicial review proceedings against the Minister for Local Government, James Browne TD, for failing to create regulations that will enable local authorities to change placenames under the Local Government Act 2001.
The aforementioned six councillors are: Conor Reddy (PBP), Cieran Perry (Ind), Ciarán Ó Meachair (SF), Mícheál Mac Donncha (SF), Niall Ring (Ind) and Vincent Jackson (Ind). Represented by Shortall Law, they argue that proposals to change the placenames of two Dublin City parks, Herzog Park and Diamond Park – the former named for Irish-born Israeli president Chaim Herzog – have stalled due to the Minister's inaction.
Part 18 of the Local Government Act 2001, as amended in 2019, provides for the alteration of placenames by local authorities. The procedure requires the Minister to make regulations governing the conduct of secret ballots on proposed placename changes. Seven years after the relevant provisions were commenced, no regulations have been made. As a consequence, no placename in the State can be changed by a local authority.
